1. Agreement to Terms
By accessing or using the Scarecrow AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as acceptance by that organization.
These Terms apply to all users of the Service, including but not limited to site administrators, operators, viewers, and any other users who access or use the Service.
2. User Obligations
As a user of the Scarecrow AI platform, you agree to:
- Provide accurate, current, and complete information when creating your account
- Maintain the security of your login credentials and immediately notify us of any unauthorized use
- Use the Service only for lawful purposes and in accordance with these Terms
- Comply with all applicable local, state, national, and international laws and regulations
- Respect the privacy and rights of individuals who may appear in camera feeds
- If you are an administrator, properly manage user access and ensure appropriate use of camera data
- Not attempt to gain unauthorized access to other users' accounts or data
- Report any security vulnerabilities or suspicious activity to Scarecrow AI immediately
3. License to Use the Platform
Subject to these Terms, Scarecrow AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your intended business purposes.
This license does not include any rights to:
- Sell, rent, lease, or otherwise transfer your rights in the Service to any third party
- Modify, distribute, or create derivative works based on the Service
- Access the Service's underlying software, algorithms, or source code
- Use the Service for any purpose other than as expressly permitted by these Terms
Scarecrow AI retains all rights, title, and interest in and to the Service, including all related intellectual property rights.
4. Restrictions
You expressly agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
- Resell, redistribute, or provide access to the Service to any third party without authorization
- Use automated tools to scrape, extract, or harvest data from the Service
- Redistribute, share, or publicly display camera feeds without proper authorization
- Attempt to bypass, disable, or interfere with security features or authentication mechanisms
- Introduce viruses, malware, or other harmful code into the Service
- Tamper with or manipulate AI-generated data or analytics
- Use the Service in any way that could damage, disable, overburden, or impair our servers or networks
- Violate any applicable laws regarding privacy, surveillance, or data protection
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Scarecrow AI and its licensors. This includes but is not limited to:
- The Scarecrow AI logo, trademarks, and branding
- All AI models, algorithms, and machine learning technologies
- User interface designs, layouts, and system architecture
- Analytics dashboards, reports, and data visualization tools
- All documentation, help materials, and educational content
The Service is protected by copyright, trademark, and other laws. You may not use our trademarks or branding without our express written permission.
6. SMS Terms – Scarecrow AI Alerts
Program Name: Scarecrow AI Alerts
Scarecrow AI Alerts is a transactional SMS messaging program operated by Cactus Code and Web Designs LLC for the Scarecrow AI platform.
Types of Messages
Scarecrow AI Alerts sends transactional and operational messages related to the Scarecrow AI platform, including:
- Account notifications
- Verification codes
- Security alerts
- Camera and site-status notifications
- Event notifications
- Event-resolution and all-clear messages
- System-status updates
Scarecrow AI Alerts does not send marketing or promotional SMS messages.
Opt-In
Users opt in by visiting the Scarecrow AI dashboard, entering their mobile phone number into an optional phone-number field, and manually checking an unchecked SMS consent checkbox.
The consent checkbox states that the user agrees to receive recurring Scarecrow AI SMS alerts and account notifications from Cactus Code and Web Designs LLC, operator of Scarecrow AI. The checkbox disclosure includes message frequency, message and data rates, HELP instructions, STOP instructions, Terms, and Privacy Policy links.
Consent to receive SMS messages is not a condition of purchase or use of Scarecrow AI services.
After submitting the opt-in form, users may receive a confirmation or double opt-in message before recurring SMS alerts are enabled.
Message Frequency
Message frequency varies based on account activity, site activity, security events, camera events, and system-status conditions. Users may receive no messages on some days and multiple messages on days when alerts or account events occur.
Message and Data Rates
Message and data rates may apply. Standard messaging and data rates from your wireless carrier may apply.
Opt-Out
You may opt out at any time by replying STOP to any Scarecrow AI Alerts message. After opting out, you will receive confirmation that you have been unsubscribed and no further SMS messages will be sent unless you re-subscribe.

Re-Subscribe
If you previously opted out, you may reply START to re-subscribe where supported.
Delivery Disclaimer
SMS message delivery depends on wireless carrier networks and device availability. Scarecrow AI cannot guarantee delivery or timing of SMS messages. SMS alerts should not be used as the sole security notification method.
Privacy
Mobile phone numbers, SMS opt-in data, and SMS consent information are handled according to our Privacy Policy. We do not sell, rent, share, or transfer mobile information or SMS consent information to third parties or affiliates for marketing or promotional purposes.
7. Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Scarecrow AI expressly disclaims all warranties of any kind, whether express or implied.
We do not warrant that:
- The Service will be available 100% of the time or free from interruptions
- AI-generated insights, alerts, or analytics will be completely accurate or real-time
- Camera feeds will be continuously available or of consistent quality
- The Service will meet your specific requirements or expectations
- Any errors in the Service will be corrected promptly
AI-generated insights are informational only and should not be relied upon as the sole basis for security or operational decisions. Always verify critical information through multiple sources.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Scarecrow AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Service interruptions or downtime
- Security breaches caused by user misconfiguration or misuse
- Damages resulting from reliance on AI-generated insights
- Any damages arising from unauthorized access to your account due to compromised credentials
Our total liability to you for any damages shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so these limitations may not apply to you.
9. Termination of Access
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms of Service
- Violation of applicable laws or regulations
- Fraudulent, abusive, or harmful behavior
- Non-payment of fees (for paid accounts)
- Prolonged inactivity
You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account data in accordance with our data retention policies
- You remain liable for any charges incurred prior to termination
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California.
You agree to submit to the personal jurisdiction of the courts located in California for any actions not subject to arbitration.
11. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be notified to users through:
- Email notification to your registered email address
- In-app notifications in your dashboard
- Updates to this page with a new "Last updated" date
Your continued use of the Service after any changes to these Terms constitutes acceptance of the new terms. If you do not agree to the new terms, you must stop using the Service.
We recommend reviewing these Terms periodically to stay informed of any updates.
